when you buy contaminated property in Michigan. BEA stands
for 'baseline environmental assessment' and is
pronounced by each letter B-E-A and not like the flying insect.
A BEA establishes a baseline of the contamination on
site before you purchase OR occupy contaminated
property. This baseline is used to separate old contamination from
new. (Hopefully there won't be any new contamination. )
There are three different kinds of BEA, each dependant
on the future use of the property.
 | Category "N" BEA is completed when
contaminated property will be used for a use that does not include
chemicals; "N" is for No chemicals used"
(except ordinary cleaning chemicals) |
 | Category "D" BEA is completed when the
future use of the property included different chemicals than
those contaminating the property. |
 | Category "S" BEA is completed when the same
chemicals will be used on site than those that the property is
contaminated with. |
Category "N" BEA are usually simple to
complete, while the category "D" and "S" can be
complex. A BEA can be completed only when the property is
contaminated above the state of Michigan criteria.
If you are planning to purchase or lease property that
may be contaminated, allow enough time to complete the due diligence and
BEA process. A BEA must be completed within 45 days of purchase or
occupant.
